Digital Millennium Copyright Act Policy

Gaxload.com ("the Site") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Gaxload will respond expeditiously to claims of copyright infringement committed using the Gaxload service and/or the Gaxload website if such claims are reported to our Designated Copyright Agent identified in the sample notice below. If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Gaxload’s Designated Copyright Agent. Upon receipt of Notice as described below, Gaxload will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Note to Indie Developers

We are huge fans of the indie game community. If you are a developer and found your game on our site:

  1.  Removal: If you want your game removed completely, please send a request, and we will process it immediately.
  2.  Claim/Update: If you prefer to keep the game listed but want to update the download links to your official Patreon/Itch.io page (to drive traffic/support to you), we are happy to do so. Just let us know!

DMCA Notice of Alleged Infringement ("Notice")

To file a DMCA notice, please send an email to [contact@gaxload.com] containing the following information:

  1.  Identification of the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
  2.  Identification of the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on the Site or the exact location where such material may be found.
  3.  Your company affiliation (if applicable), mailing address, telephone number, and, if available, email address.
  4.  Include both of the following statements in the body of the Notice:

   

  • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."   
  • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of, the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  1.  Provide your full legal name and your electronic or physical signature. Deliver this Notice, with all items completed, to: Email: [contact@gaxload.com]  (Please put "DMCA Takedown Request" in the subject line)

Counter Notices

One who has posted material that allegedly infringes a copyright may send Gaxload a counter notice pursuant to Sections 512(g)(2) and 512(g)(3) of the DMCA. When Gaxload receives a counter notice, it may in its discretion reinstate the material in question in not less than 10 nor more than 14 days after it receives the counter notice unless it first receives notice from the copyright claimant that they have filed a legal action to restrain the allegedly infringing activity. To provide a counter notice to us, please return the following form to the Designated Copyright Agent specified above:

  1.  Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2.  Your name, address, and telephone number.
  3.  A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4.  Your signature (physical or electronic).

Repeat InfringersIt is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.
